These Terms and Conditions ('Terms') govern your use of www.timetoldletters.com (the 'Website') and your subscription to the Time Told™ Letters service (the 'Service'). They form a legally binding agreement between you and Time Told™ Letters.

These Terms should be read alongside our other policies, all of which form part of the agreement between us:

2. Definitions

In these Terms, the following words have the meanings set out below:

3.1 Age Requirement

You must be at least 18 years of age to subscribe to the Service or make a purchase on the Website. By subscribing or placing an Order, you confirm that you are 18 or over.

If you are subscribing as a gift for another person, you confirm that you are 18 or over and that you are authorised to enter into this agreement on behalf of the transaction.

3.2 Legal Capacity

By accepting these Terms, you confirm that you have full legal capacity to enter into a binding contract. If you are acting on behalf of a business or organisation, you confirm that you have authority to bind that entity to these Terms.

3.3 International Subscribers

The Service is available to subscribers outside the United Kingdom, subject to postal availability to your country. International subscribers are responsible for ensuring that receipt of the Service complies with any local laws or restrictions applicable in their country.

Time Told™ Letters does not represent that the Website or Service is appropriate or available in all jurisdictions. Access to the Website from territories where its content may be illegal is prohibited.

4. The Service

4.1 Description

Time Told™ Letters is a monthly postal subscription service. Each month, subscribers receive a physical letter containing a personal story, life lesson, or piece of advice shared by a Contributor from an older generation. Each Letter is presented on a quality A4 paper. The length and extent of each letter may vary, but shall generally be no less than two sides of A4 paper.

4.2 Service Availability

We will use reasonable endeavours to dispatch a Letter to you each month. However, the Service is dependent on Contributor availability and the ongoing operation of postal services. We do not guarantee uninterrupted delivery and accept no liability for delays caused by third-party postal carriers.

4.3 Content Variation

The content of each Letter, including the theme, subject matter, and personal details shared, is determined by the Contributor and will vary from month to month. We do not guarantee any particular theme, topic, or content, and we reserve the right to exercise editorial discretion over which contributions are included in the Service.

4.4 Content Sensitivity

Letters may contain personal and sensitive subject matter, including references to bereavement, illness, relationships, hardship, or other life experiences. By subscribing, you acknowledge that such content may be included and that you are comfortable receiving it.

4.5 Service Changes

We reserve the right to modify, suspend, or discontinue the Service or any aspect of it at any time, with or without notice, provided that where such change materially affects active subscribers, we will give reasonable advance notice and offer a pro-rata refund where applicable.

5. Subscriptions and Ordering

5.1 Subscription Plans

We offer five Subscription Plans: 1-Month, 3-Month, 6-Month, 9-Month, and 12-Month. Full details of pricing and billing cycles are set out on the Website and in our Subscription & Cancellation Policy.

5.2 Placing an Order

By completing the checkout process and submitting payment, you are making an offer to subscribe to the Service on the terms set out on the Website and in these Terms. Your Order is accepted, and a contract formed between us, when we send you a written confirmation of your subscription by email.

We reserve the right to decline any Order for any reason, including but not limited to payment failure, suspicion of fraudulent activity, or inability to deliver to your address. If we decline your Order, we will refund any payment taken in full.

5.3 Accuracy of Information

You are responsible for ensuring that all information provided at the time of subscribing, including your name, email address, and postal delivery address, is accurate and complete. Time Told™ Letters accepts no responsibility for non-delivery or service failure resulting from inaccurate information provided by you.

5.4 Automatic Renewal

All Subscription Plans renew automatically at the end of each billing cycle unless cancelled before the renewal date. You will receive a reminder email at least 7 days before renewal. By subscribing, you authorise us to charge your payment method at each renewal at the then-current price.

5.5 Gifted Subscriptions

Subscriptions may be purchased as a gift. The gift buyer enters into the subscription contract and is responsible for all associated obligations, including payment. The 14-day cooling-off right runs from the date of purchase, not the date the recipient activates the subscription. Once activated, gifted subscriptions are non-refundable outside the cooling-off period.

6. Pricing and Payment

6.1 Prices

All prices are displayed on the Website in pounds sterling (GBP) and are inclusive of any applicable VAT. Prices for international subscribers are charged in GBP. Any currency conversion costs or foreign transaction fees are the responsibility of the subscriber and will depend on your bank or payment provider.

6.2 Payment Processing

We process payments via Stripe. By providing your payment details, you authorise us to charge the applicable subscription amount to your chosen payment method at the start of each billing cycle. Your payment information is handled securely by Stripe and is not stored by Time Told™ Letters. Stripe's terms and privacy policy govern the processing of your payment data.

6.3 Failed Payments

If a payment fails at the point of renewal, we will notify you by email and attempt to collect payment again. If payment cannot be collected after two (2) further attempts, your subscription will be paused and Letters will not be dispatched until payment is resolved. We accept no liability for missed Letters arising from payment failure caused by issues with your payment method or bank.

6.4 Price Changes

We reserve the right to change our subscription prices. We will give you at least 30 days' notice of any price increase by email. Price changes will take effect from your next renewal date only. You may cancel before the new price takes effect if you do not wish to continue. Continued subscription after a price change constitutes acceptance of the new price.

6.5 Taxes and Duties: International Subscribers

International subscribers are solely responsible for any import duties, customs charges, taxes, or other levies imposed by their country on receipt of physical mail. Time Told™ Letters has no liability for such charges and will not reimburse them under any circumstances.

7. Your Right to Cancel: Cooling-Off Period

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers based in the United Kingdom have a statutory right to cancel their subscription within 14 days of purchase without giving any reason and receive a full refund.

7.1 How to Cancel Within the Cooling-Off Period

To exercise your right to cancel, you must clearly notify us before the 14-day period expires using one of the following:

Any clear written statement of your intent to cancel is sufficient. You do not need to use a specific form.

7.2 Effect on Refund

If you cancel within the 14-day cooling-off period and no Letter has been dispatched, you will receive a full refund within 14 days. If a Letter has already been dispatched and received, we reserve the right to deduct a proportionate amount from the refund to reflect the portion of the Service already delivered. 7.3 International Subscribers and Cooling-Off Rights

The 14-day cooling-off right under the Consumer Contracts Regulations 2013 applies to consumers in the United Kingdom and, in equivalent form, across the European Economic Area under the EU Consumer Rights Directive. Subscribers based outside these territories may have equivalent rights under their local consumer protection laws. We will endeavour to honour equivalent cancellation requests from international subscribers in good faith, though we are not legally obliged to do so beyond UK and EEA law.

8. Cancellation After the Cooling-Off Period

You may cancel your subscription at any time after the cooling-off period. Cancellation will take effect at the end of your current paid billing cycle. No further renewals will occur. We do not offer partial refunds for unused months remaining in a billing cycle outside of the cooling-off period, except in exceptional circumstances at our discretion.

9. Delivery

9.1 Dispatch

We aim to dispatch each monthly Letter on the second (2nd) Wednesday of each calendar month. Delivery times will vary depending on your location and the postal service used.

9.2 UK Delivery

UK Letters are dispatched via Royal Mail. Standard delivery times apply. Time Told™ Letters is not responsible for delays caused by Royal Mail or any other postal carrier. A second (2nd) class postal service will be used by default. Please refer to the official Royal Mail website for guidance on the approximate delivery times and conditions for second class mail.

9.3 International Delivery

We offer international delivery to a range of countries. International postage times vary significantly by destination. Time Told™ Letters cannot guarantee delivery dates for international subscribers and accepts no liability for delays caused by customs processing, international postal services, or local delivery carriers.

International subscribers are responsible for any customs clearance requirements applicable in their country and for any associated fees. If a Letter is returned to us due to customs rejection or an incorrect address, we will contact you to arrange re-delivery at your cost, or issue a partial refund at our discretion.

International Letters are dispatched via the UK Royal Mail service. Standard delivery times apply. Time Told™ Letters is not responsible for delays caused by Royal Mail or any other postal carrier. A second (2nd) class postal service will be used by default. Please refer to the official Royal Mail website for guidance on the approximate delivery times and conditions for second class mail.

9.4 Non-Delivery

If your Letter has not arrived within 7 working days of the expected delivery date, please contact us at mail@timetoldletters.com. Where we are satisfied a Letter has been lost in transit, we will offer a replacement or a credit equivalent to one month's subscription. Full details are set out in our Refund Policy.

9.5 Risk

Risk in a Letter passes to you on delivery. Time Told™ Letters is not responsible for loss, theft, or damage to a Letter after it has been delivered to the address you provided.

10. Intellectual Property and Copyright

10.1 Ownership of Website Content

All content on the Website, including text, branding, design, imagery, and the Time Told™ Letters name and logo, is the intellectual property of Time Told Ltd and is protected by the Copyright, Designs and Patents Act 1988 and applicable international copyright law. Nothing in these Terms grants you any licence or right to use any such content without our prior written consent.

10.2 Contributor Letters

Each Letter contains personal content authored by a Contributor. Contributor stories are original literary works protected by copyright from the moment of their creation. Contributors retain their underlying authorship rights. Time Told™ Letters holds a licence to publish and distribute Letters as part of the Service under the terms of each Contributor's signed Contributor Agreement.

10.3 Subscriber Obligations

Letters are provided to subscribers for personal enjoyment only. Subscribers must not:

10.4 Feedback and Suggestions

If you provide us with feedback, suggestions, or ideas regarding the Service, you grant us a perpetual, royalty-free, worldwide licence to use that feedback for any purpose without obligation to you.

11. Acceptable Use of the Website

11.1 Permitted Use

You may use the Website for lawful purposes only and in accordance with these Terms. You agree not to use the Website:

We reserve the right to suspend or terminate your access to the Website and/or your subscription without notice if we reasonably believe you have breached these Terms. We may also report any breach to the relevant law enforcement authorities.

12. Privacy and Data Protection

We are committed to protecting your personal data. Our Privacy Policy sets out in full how we collect, use, store, and protect your personal information, and explains your rights under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

By subscribing to the Service and using the Website, you acknowledge that you have read and understood our Privacy Policy. Our use of cookies is governed by our separate Cookie Policy.

Where you provide us with personal data relating to a third party (for example, a gift recipient's name and address), you confirm that you have that person's consent to share their information with us for the purposes of fulfilling the subscription.

13. Disclaimers

13.1 Nature of Content

The Letters and all content distributed as part of the Service reflect the personal views, memories, and opinions of individual Contributors. They do not represent the views of Time Told™ Letters. Nothing in any Letter should be construed as professional advice of any kind, including medical, legal, financial, or psychological advice.

If you are affected by any content in a Letter or on the Website, please seek appropriate professional support.

13.2 Accuracy

Whilst we take care to work respectfully with Contributors, we do not independently verify the factual accuracy of stories shared. The stories are personal accounts shared in good faith. Time Told™ Letters accepts no liability arising from any inaccuracy, misrepresentation, or omission in Contributor content.

13.3 Website Availability

We do not guarantee that the Website will always be available, error-free, or secure. We may suspend access to the Website for maintenance or other operational reasons. We accept no liability for any loss or inconvenience arising from unavailability of the Website.

13.4 Third-Party Links

The Website may contain links to third-party websites. We have no control over the content, privacy practices, or security of third-party sites and accept no responsibility for them. The inclusion of a link does not constitute an endorsement.

14. Limitation of Liability

14.1 Consumer Rights Not Affected

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under applicable law, including the rights of consumers under the Consumer Rights Act 2015.

14.2 General Limitation

Subject to clause 14.1, our total liability to you in connection with the Service or these Terms, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount paid by you to us in the 12 months immediately preceding the event giving rise to the claim.

Subscribers based outside the United Kingdom acknowledge that the limitation of liability set out in this clause is governed by English law. Mandatory consumer protection provisions in your local jurisdiction may apply in addition to or in place of these limitations where such provisions cannot be contracted out of.

You agree to indemnify, defend, and hold harmless Time Told™ Letters and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with:

16. Statutory Rights: UK Consumers

If you are a consumer based in the United Kingdom, you have statutory rights under the Consumer Rights Act 2015, including the right to receive a service performed with reasonable care and skill and within a reasonable time. Nothing in these Terms affects those statutory rights.

UK consumers also benefit from the protections afforded by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 as set out in clause 7.

17. International Consumer Rights

17.1 European Economic Area

Subscribers in the EEA benefit from equivalent consumer protections under the EU Consumer Rights Directive, including a 14-day right of withdrawal. EEA subscribers may also have rights under their national consumer protection laws.

17.2 Australia

Subscribers in Australia may have rights under the Australian Consumer Law (Competition and Consumer Act 2010). Our goods and services come with consumer guarantees that cannot be excluded. Nothing in these Terms is intended to exclude or restrict any right you have under Australian Consumer Law.

17.3 Canada

Subscribers in Canada may have rights under applicable federal and provincial consumer protection legislation, including but not limited to the Electronic Commerce Protection Act and applicable provincial consumer protection acts.

17.4 United States

Subscribers in the United States may have rights under applicable state and federal consumer protection laws. Nothing in these Terms is intended to waive any right you may have under applicable US law that cannot be contracted out of.

17.5 General

Where any mandatory consumer protection law in your jurisdiction provides rights that cannot be excluded by contract, those rights are preserved. These Terms are not intended to override any such mandatory protections.

18. Force Majeure

Time Told™ Letters shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to:

19.3 No Waiver

Our failure to insist upon or enforce any provision of these Terms shall not be construed as a waiver of our right to enforce the same provision or any other provision in the future.

20. Variation of These Terms

We may update these Terms from time to time to reflect changes to the law, our business, or the Service. When we do, we will update the 'Last updated' date at the top of this document. Where changes are material, we will notify active subscribers by email with at least 30 days' notice before the changes take effect.

Your continued use of the Website or the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree with any changes, you may cancel your subscription before the changes take effect.

21. Assignment

You may not transfer, assign, or sub-contract any of your rights or obligations under these Terms without our prior written consent.

Time Told™ Letters may assign or transfer its rights and obligations under these Terms to any third party, for example in the event of a business sale or restructuring, provided that your rights under these Terms are not materially diminished as a result. We will notify you if such an assignment takes place.

22. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, Subscription & Cancellation Policy, Refund Policy, and Copyright Notice, constitute the entire agreement between you and Time Told™ Letters in relation to the Website and the Service and supersede all prior representations, agreements, and understandings.

No oral representation or agreement shall modify these Terms. Any variation must be agreed in writing by Time Told™ Letters.

24. Third-Party Rights

These Terms do not confer any rights on any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise, except that a Contributor's rights in respect of their Letter content are acknowledged as a matter of copyright and as provided under any applicable Contributor Agreement.

25. Governing Law and Jurisdiction

25.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales.

25.2 Jurisdiction

Subject to clause 25.3, both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute or claim arising out of or in connection with these Terms or the Service.

25.3 Consumer Jurisdiction Rights

If you are a consumer, you may also be entitled to bring proceedings in the courts of the country in which you are resident. Nothing in this clause affects your statutory right as a consumer to bring proceedings in your local courts under applicable mandatory consumer protection laws.
